What is the contribution limit for a Solo 401k?

The IRS sets limits for how much you can contribute to a Solo 401k. See the current contribution limits.

What are the distribution rules for a Solo 401k?

Like other retirement plans, distribution rules for a Solo 401k are subject to specific guidelines set by the IRS, and it’s important to note that Solo 401k distribution rules can be complex and may vary based on plan specifics, your age, and other factors. Generally, you can start taking penalty-free distributions from your Solo 401k once you reach age 59½. Distributions taken before this age may be subject to a 10% early withdrawal penalty, in addition to regular income taxes, unless an exception applies. Additionally, Required Minimum Distributions (RMDs) must begin by April 1st of the year following the year you turn 73, (unless you turned 72 prior to January 1, 2023, then your RMDs must begin by 72). 

Who can have a Solo 401k?

Self-employed individuals and business owners without any non-owner employees are eligible to have this account. Owner’s spouses may also participate if they are working in the business, as well

What is considered self-employment income?

Self-employment income is earned from carrying on a “trade or business” as a sole proprietor, an independent contractor, or some form of partnership. To be considered a trade or business, an activity does not necessarily have to be profitable, and you do not have to work at it full time, but profit must be the end goal. Some examples of self-employment income are: contract work, freelancing, driving for Uber and Lyft, working a full-time job and a part-time side gig, receiving a Form 1099-MISC, or even hosting a property on Airbnb.

What is needed to fully establish a Solo 401k?

You will need to complete the account paperwork, obtain an EIN, and establish a checking account for the Solo 401k

If I already have a full-time job as an employee, can I still open a Solo 401k plan for my side business? 

If you are self-employed or have income from freelancing, you can still open a Solo 401k plan. You won’t be able to make pretax or Roth Solo 401k contributions if you have already maxed out these contributions to your day job employer 401k plan, but you will still be able to make profit sharing contributions to the Solo 401k plan

Can I rollover/transfer my current retirement plan to a Solo 401k? 

The type of plan or account from which you are intending to roll/transfer the funds will determine its portability. If the funds are in a rollover or conduit IRA, Traditional IRA, SEP IRA, TSP, 457b, pension, a profit-sharing or a former employer 401k plan, they can be rolled into the Solo 401k as long as you did not make any after-tax contributions to those IRAs

Can I use any bank account for my Solo 401k checking account?

You may use any bank since the account is simply a trust checking account to hold your money. Your real Solo 401k account is your set of IRS-approved documents. The bank account is simply a depository for your funds
